FixSor Terms of Service

Please note that you are agreeing to the following terms of service by using the FixSor.com site and/or requesting service.

ChargeMatic, Inc. d/b/a FixSor (“FixSor”) and you enter into this agreement (“Agreement”) as a user of the website ("You"). By using the FixSor site, you acknowledge and agree to the terms and conditions stated in this document as well as terms laid down in the privacy policy of the FixSor.com website. You accept that you will be governed by the terms of service laid down in both these documents with reference to each page of this website as well as the provision of both free and subscription-only information to you by or through the website (the "Service").

Fixsor reserves the right to make changes to this Agreement as well as the website FixSor.com at any time for any reason without giving any prior notice. You also agree to abide by these revised terms of service and changes made to the Agreement at all times. For this reason, we urge you to visit FixSor periodically and review the terms and conditions of this Agreement.

1. Our Services

Once you have submitted your information and sent us a request, we will provide you a list of service professionals in your area, if available. Please note that we do not guarantee that we will be able to provide you with a service professional in your vicinity who is capable or willing to meet your service needs. We also do not guarantee that we will be able to match your service needs.

Service professionals recommended by FixSor will provide Service to you.  Though we take all necessary steps to ascertain the credentials of such service professionals, FixSor does not guarantee and cannot be held responsible for the installation or application skills of such service professionals, or the job that he or she may undertake for you. You may enter into a direct contract with a service professional. FixSor does not guarantee the performance of the service professional or the outcome or quality of service. Any contract entered into by you and your state and local laws govern the service professional. All disputes are to be taken up with the service professional directly.

Please note that by agreeing to these terms of service, you hereby agree to release FixSor (and our employees, business partners and agents), and any other person, firm, or entity from any claims for damages of any kind of nature, suspected or unsuspected, known or unknown, disclosed or undisclosed, that may arise from such disputes or from your contract with the service professional.

Billing

• FixSor method of accepting payments is by credit card only. You must provide FixSor with current, valid credit card information at the time of your subscription to our service. FixSor will then bill your credit card for the total amount due at the time of subscription for $99.00 setup fee and then bill you a Monthly Fee – Member authorizes FixSor to charge their credit card a $24.99 recurring monthly fee, which is automaticly deduected from you prepaid amount, which waived for the first month.

• Contractors’ joining our lead program needs to prepay $200.00 in their account. Each lead contractor accepts the cost of the lead deducted from your prepaid balance. If you decide to end your account, a refund of the balance funds left on account is refund to you.

• Credit/Refund, for leads - In the event you contacted a lead and they indicated that, they have changed their interest or for any other reasons. All you need to do is log into your account and submit the lead for credit. We have made petitioning for a bad lead as easy as we can. Allow up to 5 days for review and refund.

   2. Termination of Service and Refunds

You may terminate this agreement after the initial term at any time by calling FixSor at 718-673-4946. An email confirmation of your cancellation will broadcast to your email address designated by you when you subscribed to the service. Cancellations by email or by any other means will not be accepted for any reason. All cancellations will become effective from the first day after your current term immediately preceding the receipt of your cancellation request expires. Setup fees and montly fees are none refundable.

Fixsor may terminate this agreement without any prior notice in case you are unable to make a due payment, or the issuer denies the transaction of a credit card provided by you, or any action taken by you that is in breach of this agreement.

3.  Security Issues and Secure Pages

At FixSor, we would like to provide you with a secure and safe environment, and will undertake all necessary steps to secure all personal and financial information submitted by you. Some of the pages requiring information may be certified as Secure Sockets Layer or SSL pages. Please protect your personal and financial information by all necessary means, especially if you are using a shared computer. You may be required to sign other documents, which support the documents, and disclaimers that are necessary for submitting applications that appear on our site. The signed document will be final and binding, and all other disclaimers and documents that appear on our site will be incorporated into that document. If there are any differences or disputes between the online document and the subsequently signed document, the dispute will be resolved by, relying on the signed document at all times. Until FixSor has not sent the confirmation of acceptance of an application, any application submitted on FixSor shall be deemed to be ‘pending acceptance and approval’. Any payment made to FixSor, shall be credited back to the applicant’s credit card account in a reasonable period in case FixSor has not accepted their application.

4. Treatment of Information provided by you

While using our site, you may be asked to provide us with personal information about yourself and your service requirements. You will also be able to store home service records and other information on our website. We may forward some or all of this information to service professionals so that they may respond to you or to other persons with reference to our business. By submitting this information or a service application, you consent to being contacted by us and our service professionals at any of your contact numbers and addresses by phone, email, fax, mail or any other form of communication so that we can provide the services on our site, service your account, address any issues or for other matters pertaining to our business. Please read our privacy policy for complete information on our use of your personal information.

You also consent to entering into a business relationship with FixSor and its partners when you submit a service request, and being contacted by our partners or us at any time thereafter. You promise to provide us with accurate information that is updated and truthful. Any incomplete or incorrect information provided by you will not be acceptable. If FixSor believes that you have provided us with inaccurate, incomplete or incorrect information, we reserve the right to refuse any current or future use of any of FixSor’s services by you. You are also responsible for any use of your account with FixSor by any person or persons who you have advertently or inadvertently given access to your password to. You also acknowledge that FixSor may send any personal and loan related information submitted by you to any of our lender partners when you send us a request for a loan quote from any of our lender partners through our site. You expressly agree to being contacted by them with reference to your request, and to such contact by them or by FixSor as may be necessary to execute your request.

5. Use Of FixSor’s Services

By agreeing to these terms to service, you acknowledge and agree that you will not use any of the FixSor services for commercial use or for any advertising purposes, and will only use our services for personal use. You agree that any content and information published on the FixSor website, including but not limited to screening information and contractor information, is the sole property of FixSor. FixSor holds the exclusive rights for reproducing, posting, publishing and using the information on the site, and you have no right to reuse any information on the FixSor site that does not pertain to your service request or for your personal use. You agree that you may be liable to FixSor for any violation of these terms, and agree to pay significant damages to FixSor in case of any violation of use. You also agree to indemnify FixSor for any third party claims on FixSor that may result from your misuse and violation of the foregoing. FixSor reserves the right to disallow you access to our site and services at any time.

Please note that all information about our services and service professionals is for your personal use only. If FixSor feels that you are misusing the FixSor site or attempting to misuse the FixSor site, to get around the services or system on our site, or are trying to use it for any illegal, immoral, non-personal, or commercial purposes that may include but is not limited to activities like hacking, fraud, advertising, spamming, jamming, infiltration or any unauthorized use, FixSor reserves the right to stop you from accessing the site without any prior notice, and also reserves the right to initiate legal proceedings against you to seek appropriate remedies and/or damages, which may include but are not limited to legal fees, lost revenue, repairs, costs and expenses, and may seek injunctions or other suitable remedies.

Privacy of Email Addresses / Demographic Information

Rest asurees that your email information will not be used for commercial purposes, or sold at any time by FixSor. FixSor may send you periodical newsletters in your interest to update you about upcoming events. We shall not attribute any demographic information of an individual to any demographic information provided by you or about you when responding to any query made by FixSor.

Policy on Privacy

Please see the Privacy Policy disclosures relating to the collection and use of your information. By using the Site, you are agreeing to the processing of your data by FixSor and agreeing to our Privacy Policy.

Disclaimer about using FixSor at your own risk

By agreeing to these terms of use, you also agree that you will use this site at your own risk. FixSor or any other party involved in creating, producing, or delivering this website will not be responsible or liable for any kind of direct or indirect, accidental or intentional, consequential or punitive damages, or any losses, costs or expenses of any kind arising in any way due to access or use of this site or via any material downloaded from this site including text, data, images, audio or video. This includes any legal fees or additional expenses and covers any losses due to but not limited to viruses, bugs, human error, computer error or system malfunction, or any other failures and delays in computer data transfer or network connections, or any problems caused by the internet service provider.

Disclaimer about No Guarantee of Accuracy of Information

FixSor does not guarantee the accuracy of any information available on this site. This includes but is not limited to any information pertaining to schedules, times, entertainers, speakers, locations, performers, and any other information found on the FixSor website. While FixSor will take all reasonable precautions in making sure that the content and information on the site provided by the service is accurate, FixSor does not guarantee the same, and makes no warranties as to its accuracy. ALL CONTENT AND INFORMATION ON THIS SITE IS PRESENTED TO YOU ON AN ‘AS-IS WHERE-IS’ BASIS, AND THERE IS NO GUARANTEE OF ANY KIND, EITHER EXPRESSED OR IMPLIED, TO THE ACCURACY OR GENUINITY OF THE AFOREMENTIONED INFORMATION INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A SPECIFIC PURPOSE, TITLE AND NONINFRINGEMENT.

FIXSOR WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS OF PROFITS, DATA, BUSINESS OR BUSINESS INTERRUPTION, OR SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES UNDER ANY CIRCUMSTANCES, EVEN IF FIXSOR HAS BEEN SPECIFICALLY ADVISED THAT SUCH POSSIBILTY MAY EXIST. THE LIABILTY OF FIXSOR TO YOU, OR ANY OTHER PERSON, FIRM OR ENTITY CAN NEVER EXCEED THE ACTUAL FEES PAID BY YOU TO FIXSOR UNDER ANY CIRCUMSTANCES, REGARDLESS OF THE KIND OF CLAIM.

Entire Agreement

This agreement constitutes the agreement in its entirety, and nullifies all previously written or oral agreements and communication pertaining to the subject matter of this Agreement.

No Waivers

Fixsor will not be responsible for any failure to exercise or delay in exercising, by any party, privilege, power or rights, and any such failure will not function as a waiver thereof, nor will any single or partial exercise of any right or power hereunder preclude further exercise of any other right hereunder. Waivers or amendments will not be applicable unless made in writing and signed by an authorized FixSor representative.
